EULA - End User License Agreement

End User License Agreement

By installing this software product, you agree to the following legal
agreement between you and Rainy City Computer. Installing this soft-
ware indicates your acceptance of these terms and conditions.

1) License - This License Agreement grants you one license to use this software
on your Personal Computers (PC). Because of the special nature of the pro-
duct (requiring 2 PCs to function), this license covers up to 3 PCs. In
the case of institutional, government or corporate usage where the software
is installed on many PCs, one license is required for every 2 PCs. You may
not modify, reverse engineer, disassemble or otherwise attempt to derive
source code from this product.
2) Transfer - You may transfer this license to another party only if that party
agrees to the terms and conditions of this agreement. You may transfer
this license only if you permanently destroy all copies of the software in
your possession. You have no right to sub-license or loan the software.
3) Title And Copyright - Title, ownership rights and intellectual property
rights to the software shall remain with Rainy City Computer. The
software is protected by United States and international copyright laws
and international treaty provisions. Do not remove or alter any notice of
copyright, trademarks or other proprietary rights.
4) Term - This license is effective until terminated. This license and your
right to use the software terminate automatically if you violate any part
of this agreement. You agree upon termination, to immediately return or
destroy all copies of the software.
5) Limited Warranty - Rainy City Computer has made reasonable efforts
to confirm that it will perform in normal use on compatible PCs. Due to
the inherently complex nature of software, Rainy City Computer
does not warrant that the software is totally error free or is compatible
with all configurations of a PC's hardware and operating systems. Accord-
ingly, the software is provided as-is and you assume all risks associated
with its use. As your sole remedy for any breach of warranty, you may
return the software to the licensed distributor where purchased, for a
refund of the amount you paid, provided you return the software within 30
days of purchase along with a letter certifying destruction of all copies
in your possession. Rainy City Computer makes no other warranties,
express or implied on this software or its fitness for any particular
purpose. All warranties will terminate within 30 days of purchase. In no
event will Rainy City Computer or its licensed distributors be
liable for indirect, incidental or consequential damage, including without
limitations, loss of income, loss of information or damage to a PC's hard-
ware or software. In no case shall the liability exceed the amount paid for
the software.
6) General - This agreement constitutes the entire agreement between you and
Rainy City Computer and supercedes any previous oral or written
agreement. Rainy City Computer is not bound by any actions or
statements of its independent distributors.
7) Export - You agree not to transfer the software if it is in violation of any
laws, orders or restrictions on export from the United States.
